The EPA is also proposing to rescind all associated regulatory provisions currently codified in the EPA's 2024 PFAS National Primary Drinking Water Regulations (NPDWR) exclusive to these PFAS that were promulgated pursuant to the regulatory determinations that the EPA is now proposing to rescind, including the final Maximum Contaminant Levels (MCLs) that would have required monitoring, and where necessary, treatment by public water systems (PWSs). This proposed action is necessary to correct the unlawful procedure under which these regulations were promulgated. Under the EPA's prior interpretation, the EPA proposed and finalized regulatory determinations and regulations for these PFAS simultaneously and in tandem. The EPA is also finalizing individual MCLGs and is promulgating individual MCLs for PFHxS, PFNA, and HFPO-DA at 10 ng/L. In addition to the individual MCLs for PFHxS, PFNA, and HFPO-DA, in consideration of the known toxic effects, dose additive health concerns and occurrence and likely co-occurrence in drinking water of these three PFAS, as well as PFBS, the EPA is finalizing a Hazard Index (HI) of 1 (unitless) as the MCLG and MCL for any mixture containing two or more of PFHxS, PFNA, HFPO-DA, and PFBS. Once fully implemented, the EPA estimates that the rule will prevent thousands of deaths and reduce tens of thousands of serious PFAS-attributable illnesses.","document_number":"2024-07773","html_url":"https://www.federalregister.gov/documents/2024/04/26/2024-07773/pfas-national-primary-drinking-water-regulation","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2024-04-26/pdf/2024-07773.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2024-07773.pdf?1714049126","publication_date":"2024-04-26","agencies":[{"raw_name":"ENVIRONMENTAL PROTECTION AGENCY","name":"Environmental Protection Agency","id":145,"url":"https://www.federalregister.gov/agencies/environmental-protection-agency","json_url":"https://www.federalregister.gov/api/v1/agencies/145","parent_id":null,"slug":"environmental-protection-agency"}],"excerpts":"polyfluoroalkyl substances (PFAS) in drinking water. These nine PFAS are perfluorooctanoic acid (PFOA), perfluorooctanesulfonic acid (PFOS), perfluorobutanesulfonic acid (PFBS), hexafluoropropylene oxide-dimer acid (HFPO-DA or GenX), perfluorononanoic acid (PFNA), perfluorohexanesulfonic acid (PFHxS), perfluorodecanoic acid (PFDA), perfluorohexanoic acid (PFHxA), and perfluorobutanoic acid (PFBA). EPA's criteria for listing substances as hazardous constituents under RCRA require that they have been shown in scientific studies to have toxic, carcinogenic, mutagenic, or teratogenic effects on humans or other life forms. EPA reviewed and evaluated key toxicity and epidemiological studies and assessments for the nine PFAS to determine whether the available data for these PFAS meet the Agency's criteria for listing substances as hazardous constituents under RCRA. Based on EPA's evaluation, the above nine PFAS, their salts, and their structural isomers meet the criteria for being listed as RCRA hazardous constituents. As a result of this proposed rule, if finalized, when corrective action requirements are imposed at a facility, these PFAS would be among the hazardous constituents expressly identified for consideration in RCRA facility assessments and, where necessary, further investigation and cleanup through the RCRA corrective action process at RCRA treatment, storage, and disposal facilities.","document_number":"2024-02324","html_url":"https://www.federalregister.gov/documents/2024/02/08/2024-02324/listing-of-specific-pfas-as-hazardous-constituents","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2024-02-08/pdf/2024-02324.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2024-02324.pdf?1707313515","publication_date":"2024-02-08","agencies":[{"raw_name":"ENVIRONMENTAL PROTECTION AGENCY","name":"Environmental Protection Agency","id":145,"url":"https://www.federalregister.gov/agencies/environmental-protection-agency","json_url":"https://www.federalregister.gov/api/v1/agencies/145","parent_id":null,"slug":"environmental-protection-agency"}],"excerpts":"environmental justice concerns. \n VIII. Subject to the availability of appropriations, the EPA will require all community and non-transient non-community water systems (CWSs and NTNCWSs) serving 3,300 or more people, and a representative sample of PWSs serving fewer than 3,300 people, to conduct monitoring. These contaminants are not currently subject to national primary drinking water regulations (NPDWRs), and the EPA is proposing to require the collection of drinking water occurrence data to inform agency decisions. The decision to regulate or not to regulate a contaminant is known as a regulatory determination. In most cases, the contaminants chosen for regulatory determination are selected from the most recent Contaminant Candidate List (CCL), which the SDWA requires the EPA to publish every five years. This document presents the preliminary regulatory determinations and supporting rationale for contaminants listed on the EPA's fifth CCL (CCL 5). Since the fourth round of regulatory determinations was published in March 2021, the EPA has made determinations to regulate per- and polyfluoroalkyl substances (PFAS), including individual determinations for three PFAS: perfluorononanoic acid (PFNA), perfluorohexanesulfonic acid (PFHxS), hexafluoropropylene oxide dimer acid and its ammonium salt (HFPO-DA, also known as GenX or GenX chemicals); and mixtures including two or more of these three PFAS and perfluorobutanesulfonic acid (PFBS). In April 2024, the agency issued a final National Primary Drinking Water Regulation that includes these four PFAS as well as perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS). In this Federal Register Notice (FRN), the EPA is making preliminary determinations not to regulate nine additional contaminants from CCL 5: 2-aminotoluene, cylindrospermopsin, ethoprop, microcystins, molybdenum, permethrin, profenofos, tebuconazole and tribufos. The EPA requests public comment on these preliminary determinations and other aspects of this FRN. The EPA also presents updates on additional contaminants from CCL 5, as well as on some of those that have been considered in previous rounds of regulatory determinations and for which the EPA has not yet made a regulatory determination. The agency is also presenting and requesting comment on the process and analyses used for this round of regulatory determinations (i.e., RD 5), the supporting information, and the rationale used to make these preliminary decisions.","document_number":"2025-00133","html_url":"https://www.federalregister.gov/documents/2025/01/15/2025-00133/announcement-of-preliminary-regulatory-determinations-for-contaminants-on-the-fifth-drinking-water","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2025-01-15/pdf/2025-00133.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2025-00133.pdf?1736862322","publication_date":"2025-01-15","agencies":[{"raw_name":"ENVIRONMENTAL PROTECTION AGENCY","name":"Environmental Protection Agency","id":145,"url":"https://www.federalregister.gov/agencies/environmental-protection-agency","json_url":"https://www.federalregister.gov/api/v1/agencies/145","parent_id":null,"slug":"environmental-protection-agency"}],"excerpts":"determinations to regulate per- and polyfluoroalkyl substances (PFAS), including individual determinations for three PFAS: perfluorononanoic acid (PFNA), perfluorohexanesulfonic acid (PFHxS), hexafluoropropylene oxide dimer acid and its ammonium salt (HFPO-DA, also known as GenX or GenX chemicals); and mixtures including two or more of these three PFAS and perfluorobutanesulfonic acid (PFBS).
