This final rule reaffirms, with minor changes, the provisions of the interim final rule (IFR) published on September 29, 2025. Specifically, this final rule limits eligibility for non-domiciled Commercial Learner's Permits (CLPs) and Commercial Driver's Licenses (CDLs) for foreign-domiciled individuals to those who hold specific, verifiable employment-based nonimmigrant status. This rule reaffirms the IFR requirements, aligning the issuance of non- domiciled CDLs with FMCSA's statutory mandate to ensure the fitness of all drivers who operate a CMV. Specifically, the Department is revising the methodology for determining the hourly Adverse Effect Wage Rates (AEWRs) for non-range occupations by using wage data reported for each U.S. state and territory by the Department's Bureau of Labor Statistics (BLS) Occupational Employment and Wage Statistics (OEWS) survey. For the vast majority of H-2A job opportunities, the Department will use OEWS survey data to establish AEWRs applicable to five Standard Occupational Classification (SOC) codes combining the most common field and livestock worker occupations previously measured by the U.S. Department of Agriculture's (USDA) Farm Labor Survey (FLS), which covered six SOC codes. These AEWRs will be divided into two skill-based categories to account for wage differentials arising from qualifications contained in the employer's job offer. For all other occupations, the Department will use the OEWS survey to determine two skill-based AEWRs for each SOC code to reflect wage differentials. The threshold determination for assigning the SOC code(s) and applicable skill-based AEWR will be based on the duties performed for the majority of the workdays during the contract period and qualifications contained in the employer's job offer. Finally, to address differences in compensation between most U.S. workers and H-2A workers who receive employer-provided housing at no cost, the Department will implement a standard adjustment factor to the AEWR to account for this non-monetary compensation that employers will apply when compensating H-2A workers under temporary agricultural labor certifications.","document_number":"2025-19365","html_url":"https://www.federalregister.gov/documents/2025/10/02/2025-19365/adverse-effect-wage-rate-methodology-for-the-temporary-employment-of-h-2a-nonimmigrants-in-non-range","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2025-10-02/pdf/2025-19365.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2025-19365.pdf?1759263310","publication_date":"2025-10-02","agencies":[{"raw_name":"DEPARTMENT OF LABOR","name":"Labor Department","id":271,"url":"https://www.federalregister.gov/agencies/labor-department","json_url":"https://www.federalregister.gov/api/v1/agencies/271","parent_id":null,"slug":"labor-department"},{"raw_name":"Employment and Training Administration","name":"Employment and Training Administration","id":133,"url":"https://www.federalregister.gov/agencies/employment-and-training-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/133","parent_id":271,"slug":"employment-and-training-administration"}],"excerpts":"classification, and also applies to the PERM immigrant visa program, it is the only paragraph in Section 212(p) that does not reference any specific immigration programs to which it applies, and there is no legislative history indicating that it was meant to apply only to the H-1B program. Specifically, DOL is proposing to amend its regulations governing the PERM program and Labor Condition Applications (LCAs) to incorporate changes to the computation of wage levels under the Department's four-tiered prevailing wage structure based on the Occupational Employment and Wage Statistics (OEWS) wage survey administered by the Department's Bureau of Labor Statistics (BLS). These proposed revisions aim to better align prevailing wage levels with the wages paid to U.S. workers who are similarly employed in the occupation and area of intended employment. The Department's proposed revisions also seek to strengthen program integrity by reducing the incentive for employers to use these programs to replace, rather than supplement, U.S. workers by employing lower-paid alien workers. In addition, the revision would enable the Department to more effectively ensure that the employment of immigrant and nonimmigrant workers admitted or otherwise provided one of the covered statuses does not adversely affect the wages and working conditions of U.S. workers.","document_number":"2026-06017","html_url":"https://www.federalregister.gov/documents/2026/03/27/2026-06017/improving-wage-protections-for-the-temporary-and-permanent-employment-of-certain-foreign-nationals","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2026-03-27/pdf/2026-06017.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2026-06017.pdf?1774529117","publication_date":"2026-03-27","agencies":[{"raw_name":"DEPARTMENT OF LABOR","name":"Labor Department","id":271,"url":"https://www.federalregister.gov/agencies/labor-department","json_url":"https://www.federalregister.gov/api/v1/agencies/271","parent_id":null,"slug":"labor-department"},{"raw_name":"Employment and Training Administration","name":"Employment and Training Administration","id":133,"url":"https://www.federalregister.gov/agencies/employment-and-training-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/133","parent_id":271,"slug":"employment-and-training-administration"}],"excerpts":"for the Temporary Non-agricultural Employment H-2B Program, 76 FR 3452, 3461 (Jan. 19, 2011) (justifying wage methodology designed for lower-skilled workers that was adopted in the H-2B program on grounds that the program “is overwhelmingly used for work requiring lesser skilled workers,” while also acknowledging that “not all positions requested through the H-2B program are for low-skilled labor.”).\n \n \n \n Relatedly, the Department notes that the H-1B program is closely linked to the PERM programs that are also covered by the Department's wage structure"},{"title":"Privacy Act of 1974; System of Records","type":"Notice","abstract":"In accordance with the Privacy Act of 1974, the Department of Transportation (DOT) proposes to update and reissue a Privacy Act System of Records (hereafter referred to as \"Notice\") titled, \"Department of Transportation, Federal Aviation Administration DOT/FAA 847 Aviation Records on Individuals.\" This Notice covers records the FAA maintains for airman certification and training, safety inspections performed by the FAA, and actions under the FAA's compliance and enforcement program that are initiated against individuals who violate FAA statutes and regulations.","document_number":"2024-12595","html_url":"https://www.federalregister.gov/documents/2024/06/10/2024-12595/privacy-act-of-1974-system-of-records","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2024-06-10/pdf/2024-12595.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2024-12595.pdf?1717764322","publication_date":"2024-06-10","agencies":[{"raw_name":"DEPARTMENT OF TRANSPORTATION","name":"Transportation Department","id":492,"url":"https://www.federalregister.gov/agencies/transportation-department","json_url":"https://www.federalregister.gov/api/v1/agencies/492","parent_id":null,"slug":"transportation-department"},{"raw_name":"Office of the Secretary"}],"excerpts":"“Department of Transportation, Federal Aviation Administration DOT/FAA 847 Aviation Records on Individuals.” This Notice covers records the FAA maintains for airman certification and training, safety inspections performed by the FAA, and actions under the FAA's compliance and enforcement program that are initiated against individuals who violate FAA statutes and regulations. \n \n \n DATES: \n Submit comments on or before July 10, 2024.
