{"abstract":"This final rule changes the current requirement that limits on Federal Financial Participation (FFP) must be applied before States use less restrictive income methodologies than those used by related cash assistance programs in determining eligibility for Medicaid. This change was originally published as a proposed rule on October 31, 2000 (65 FR 64919). This regulatory change is necessary because the current regulatory interpretation of how the FFP limits apply to income methodologies under section 1902(r)(2) of the Social Security Act (the Act) unnecessarily restricts States' ability to take advantage of the authority to use less restrictive income methodologies under that section of the statute. While the enactment of section 1902(r)(2) of the Act could be read in the limited manner embodied in current regulations the statute does not require such a reading, and subsequent State experience with implementing section 1902(r)(2)of the Act calls into question the current regulation's approach.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF HEALTH AND HUMAN SERVICES","name":"Health and Human Services Department","id":221,"url":"https://www.federalregister.gov/agencies/health-and-human-services-department","json_url":"https://www.federalregister.gov/api/v1/agencies/221","parent_id":null,"slug":"health-and-human-services-department"},{"raw_name":"Health Care Financing Administration","name":"Health Care Finance Administration","id":559,"url":"https://www.federalregister.gov/agencies/health-care-finance-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/559","parent_id":221,"slug":"health-care-finance-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2001/01/11/01-666.html","cfr_references":[{"chapter":null,"citation_url":null,"part":435,"title":42}],"citation":"66 FR 2316","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"These regulations are effective on March 12, 2001.","disposition_notes":null,"docket_ids":["HCFA-2086-F"],"dockets":[],"document_number":"01-666","effective_on":"2001-03-12","end_page":2322,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2001/01/11/01-666.xml","html_url":"https://www.federalregister.gov/documents/2001/01/11/01-666/medicaid-program-change-in-application-of-federal-financial-participation-limits","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/01-666?publication_date=2001-01-11","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2001-01-11/01-666/mods.xml","not_received_for_publication":null,"page_length":7,"page_views":{"count":336,"last_updated":"2026-04-04 20:15:04 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2001-01-11/pdf/01-666.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2001-01-11","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2001/01/11/01-666.txt","regulation_id_number_info":{"0938-AJ96":{"issue":"201104","html_url":"https://www.federalregister.gov/regulations/0938-AJ96/use-of-restraints-and-seclusion-in-residential-treatment-facilities-providing-inpatient-psychiatric-","title":"Use of Restraints and Seclusion in Residential Treatment Facilities Providing Inpatient Psychiatric Services to Individuals Under Age 21 (CMS-2065-F)","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201104&RIN=0938-AJ96&operation=OPERATION_EXPORT_XML","priority_category":"Other Significant"}},"regulation_id_numbers":["0938-AJ96"],"regulations_dot_gov_info":{},"regulations_dot_gov_url":null,"significant":true,"signing_date":null,"start_page":2316,"subtype":null,"title":"Medicaid Program; Change in Application of Federal Financial Participation Limits","toc_doc":"Federal financial participation limits","toc_subject":"Medicaid:","topics":["Aid to Families with Dependent Children","Grant programs-health","Medicaid","Reporting and recordkeeping requirements","Supplemental Security Income (SSI)","Wages"],"type":"Rule","volume":66}
