{"abstract":"Section 101 of the Electronic Signatures in Global and National Commerce Act, Pub. L. No. 106-229, codified at 15 U.S.C. Sec. Sec. 7001 et seq. (\"ESIGN\" or \"the Act\"), preserves the legal effect, validity, and enforceability of signatures and contracts relating to electronic transactions and electronic signatures used in the formation of electronic contracts. 15 U.S.C. Sec. 7001(a). Section 103 (a) and (b) of the Act, however, provides that the provisions of section 101 do not apply to contracts and records governed by statutes and regulations regarding court documents; probate and domestic law matters; state commercial law; consumer law covering utility services, residential property foreclosures and defaults, and insurance benefits; product recall notices; and hazardous materials documents. Section 103 of the Act also requires the Secretary of Commerce, through the Assistant Secretary for Communications and Information, to review the operation of these exceptions to evaluate whether they continue to be necessary for consumer protection, and to make recommendations to Congress based on this evaluation. 15 U.S.C. Sec. 7003(c)(1). This Notice is intended to solicit comments from interested parties for purposes of this evaluation, specifically on the state uniform commercial code exception to the ESIGN Act. See 15 U.S.C. Sec. 7003(a)(3). NTIA will publish separate notices requesting comment on the other exceptions listed in section 103 of the ESIGN Act.\\1\\ ---------------------------------------------------------------------------","action":"Request For Comments","agencies":[{"raw_name":"DEPARTMENT OF COMMERCE","name":"Commerce Department","id":54,"url":"https://www.federalregister.gov/agencies/commerce-department","json_url":"https://www.federalregister.gov/api/v1/agencies/54","parent_id":null,"slug":"commerce-department"},{"raw_name":"National Telecommunications and Information Administration","name":"National Telecommunications and Information Administration","id":373,"url":"https://www.federalregister.gov/agencies/national-telecommunications-and-information-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/373","parent_id":54,"slug":"national-telecommunications-and-information-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2002/12/24/02-32405.html","cfr_references":[],"citation":"67 FR 78421","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"Written comments and papers are requested to be submitted on or","disposition_notes":null,"docket_ids":[],"dockets":[],"document_number":"02-32405","effective_on":null,"end_page":78423,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2002/12/24/02-32405.xml","html_url":"https://www.federalregister.gov/documents/2002/12/24/02-32405/the-state-uniform-commercial-code-exception-of-the-electronic-signatures-in-global-and-national","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/02-32405?publication_date=2002-12-24","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2002-12-24/02-32405/mods.xml","not_received_for_publication":null,"page_length":3,"page_views":{"count":2255,"last_updated":"2026-04-04 02:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2002-12-24/pdf/02-32405.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2002-12-24","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2002/12/24/02-32405.txt","regulation_id_number_info":{},"regulation_id_numbers":[],"regulations_dot_gov_info":{},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":78421,"subtype":null,"title":"The State Uniform Commercial Code Exception of the Electronic Signatures in Global and National Commerce Act","toc_doc":"State Uniform Commercial Code exception","toc_subject":"Electronic Signatures in Global and National Commerce Act:","topics":[],"type":"Notice","volume":67}
