{"abstract":"The Advisory Council on Historic Preservation (ACHP) has adopted amendments to the regulations setting forth how Federal agencies take into account the effects of their undertakings on historic properties and afford the ACHP a reasonable opportunity to comment, pursuant to Section 106 of the National Historic Preservation Act (NHPA). Most of the amendments respond to court decisions which held that the ACHP could not require a Federal agency to change its determinations regarding whether its undertakings affected or adversely affected historic properties, and that Section 106 does not apply to undertakings that are merely subject to State or local regulation administered pursuant to a delegation or approval by a Federal agency. Other amendments clarify an issue regarding the time period for objections to \"No Adverse Effect\" findings and establish that the ACHP can propose an exemption to the Section 106 process on its own initiative, rather than needing a Federal agency to make such a proposal.","action":"Final rule.","agencies":[{"raw_name":"ADVISORY COUNCIL ON HISTORIC PRESERVATION","name":"Advisory Council on Historic Preservation","id":225,"url":"https://www.federalregister.gov/agencies/advisory-council-on-historic-preservation","json_url":"https://www.federalregister.gov/api/v1/agencies/225","parent_id":null,"slug":"advisory-council-on-historic-preservation"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2004/07/06/04-15218.html","cfr_references":[{"chapter":null,"citation_url":null,"part":800,"title":36}],"citation":"69 FR 40544","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"These amendments are effective August 5, 2004.","disposition_notes":null,"docket_ids":[],"dockets":[],"document_number":"04-15218","effective_on":"2004-08-05","end_page":40555,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2004/07/06/04-15218.xml","html_url":"https://www.federalregister.gov/documents/2004/07/06/04-15218/protection-of-historic-properties","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/04-15218?publication_date=2004-07-06","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2004-07-06/04-15218/mods.xml","not_received_for_publication":null,"page_length":12,"page_views":{"count":1898,"last_updated":"2026-07-25 20:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2004-07-06/pdf/04-15218.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2004-07-06","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2004/07/06/04-15218.txt","regulation_id_number_info":{"3010-AA06":{"issue":"200404","html_url":"https://www.federalregister.gov/regulations/3010-AA06/protection-of-historic-properties","title":"Protection of Historic Properties","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=200404&RIN=3010-AA06&operation=OPERATION_EXPORT_XML","priority_category":"Other Significant"}},"regulation_id_numbers":["3010-AA06"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-11-12T12:39:02Z"},"regulations_dot_gov_url":null,"significant":true,"signing_date":null,"start_page":40544,"subtype":null,"title":"Protection of Historic Properties","toc_doc":"Historic properties protection","toc_subject":null,"topics":["Administrative practice and procedure","Historic preservation","Indians","Intergovernmental relations","Surface mining"],"type":"Rule","volume":69}
