{"abstract":"We are proposing to amend our regulations to include rules to carry out section 221(m) of the Social Security Act (the Act). Section 221(m) affects our rules for when we will conduct a continuing disability review if you work and receive benefits under title II of the Act based on disability. (We interpret this section to include you if you receive both title II disability benefits and Supplemental Security Income (SSI) payments based on disability.) It also affects our rules on how we evaluate work activity when we decide if you have engaged in substantial gainful activity for purposes of determining whether your disability has ended. In addition, section 221(m) of the Act affects certain other standards we use when we determine whether your disability continues or ends. We are also proposing to make certain other revisions to our regulations for how we determine whether your disability continues or ends. These other proposed revisions would codify our existing operating instructions for how we consider certain work at the last two steps of our continuing disability review process. In addition, we are proposing to incorporate into our disability regulations some rules which are contained in another part of our regulations and which apply if you are using a ticket under the Ticket to Work and Self-Sufficiency program (the Ticket to Work program). Finally, we are proposing to amend our regulations to eliminate the secondary substantial gainful activity amount that we currently use to evaluate work you did as an employee before January 2001.","action":"Notice of proposed rulemaking.","agencies":[{"raw_name":"Social Security Administration","name":"Social Security Administration","id":470,"url":"https://www.federalregister.gov/agencies/social-security-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/470","parent_id":null,"slug":"social-security-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2005/10/11/05-20266.html","cfr_references":[{"chapter":null,"citation_url":null,"part":404,"title":20},{"chapter":null,"citation_url":null,"part":416,"title":20}],"citation":"70 FR 58999","comment_url":null,"comments_close_on":"2005-12-12","correction_of":null,"corrections":[],"dates":"To be sure that your comments are considered, we must receive them by December 12, 2005.","disposition_notes":null,"docket_ids":["Regulations Nos. 4 and 16"],"dockets":[],"document_number":"05-20266","effective_on":null,"end_page":59015,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2005/10/11/05-20266.xml","html_url":"https://www.federalregister.gov/documents/2005/10/11/05-20266/exemption-of-work-activity-as-a-basis-for-a-continuing-disability-review","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/05-20266?publication_date=2005-10-11","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2005-10-11/05-20266/mods.xml","not_received_for_publication":null,"page_length":17,"page_views":{"count":106,"last_updated":"2026-08-25 20:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2005-10-11/pdf/05-20266.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2005-10-11","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2005/10/11/05-20266.txt","regulation_id_number_info":{},"regulation_id_numbers":[],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-11-12T17:16:43Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":58999,"subtype":null,"title":"Exemption of Work Activity as a Basis for a Continuing Disability Review","toc_doc":"Work activity exemption; basis for continuing disability review","toc_subject":"Social security benefits and supplemental security income:","topics":["Administrative practice and procedure","Aged","Blind","Disability benefits","Old-age, Survivors and Disability Insurance","Public assistance programs","Reporting and recordkeeping requirements","Social security","Supplemental Security Income (SSI)","Vocational rehabilitation"],"type":"Proposed Rule","volume":70}
