{"abstract":"This document amends the Department of Veterans Affairs (VA) adjudication regulations regarding the presumption of soundness of a veteran by adding a requirement that, in order to rebut the presumption of soundness of a veteran on entrance into active service, VA must prove not only that the condition existed prior to entrance into active service, but also that it was not aggravated by the veteran's active service. This amendment reflects a change in VA's interpretation of the statute governing the presumption of sound condition, and is based on a recent opinion of VA's General Counsel as well as a recent decision of the United States Court of Appeals for the Federal Circuit. The intended effect of this amendment is to require that VA, not the claimant, prove that the disability preexisted entrance into military service and that the disability was not aggravated by such service before the presumption of soundness on entrance onto active duty is overcome.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF VETERANS AFFAIRS","name":"Veterans Affairs Department","id":520,"url":"https://www.federalregister.gov/agencies/veterans-affairs-department","json_url":"https://www.federalregister.gov/api/v1/agencies/520","parent_id":null,"slug":"veterans-affairs-department"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2005/05/04/05-8899.html","cfr_references":[{"chapter":null,"citation_url":null,"part":3,"title":38}],"citation":"70 FR 23027","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"Effective Date: May 4, 2005.","disposition_notes":null,"docket_ids":[],"dockets":[],"document_number":"05-8899","effective_on":"2005-05-04","end_page":23029,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2005/05/04/05-8899.xml","html_url":"https://www.federalregister.gov/documents/2005/05/04/05-8899/presumption-of-sound-condition-aggravation-of-a-disability-by-active-service","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/05-8899?publication_date=2005-05-04","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2005-05-04/05-8899/mods.xml","not_received_for_publication":null,"page_length":3,"page_views":{"count":1217,"last_updated":"2026-04-04 18:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2005-05-04/pdf/05-8899.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2005-05-04","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2005/05/04/05-8899.txt","regulation_id_number_info":{"2900-AL90":{"issue":"200404","html_url":"https://www.federalregister.gov/regulations/2900-AL90/presumption-of-sound-condition-aggravation-of-a-disability-by-active-service","title":"Presumption of Sound Condition: Aggravation of a Disability by Active Service","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=200404&RIN=2900-AL90&operation=OPERATION_EXPORT_XML","priority_category":"Substantive, Nonsignificant"}},"regulation_id_numbers":["2900-AL90"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-11-12T15:58:45Z"},"regulations_dot_gov_url":null,"significant":false,"signing_date":null,"start_page":23027,"subtype":null,"title":"Presumption of Sound Condition: Aggravation of a Disability by Active Service","toc_doc":"Sound condition presumption; active service disability aggravation","toc_subject":"Adjudication; pensions, compensation, dependency, etc.:","topics":["Administrative practice and procedure","Claims","Health care","Individuals with disabilities","Pensions","Veterans"],"type":"Rule","volume":70}
