{"abstract":"This proposed rule would establish national emergency preparedness requirements for Medicare- and Medicaid-participating providers and suppliers to ensure that they adequately plan for both natural and man-made disasters, and coordinate with federal, state, tribal, regional, and local emergency preparedness systems. It would also ensure that these providers and suppliers are adequately prepared to meet the needs of patients, residents, clients, and participants during disasters and emergency situations. We are proposing emergency preparedness requirements that 17 provider and supplier types must meet to participate in the Medicare and Medicaid programs. Since existing Medicare and Medicaid requirements vary across the types of providers and suppliers, we are also proposing variations in these requirements. These variations are based on existing statutory and regulatory policies and differing needs of each provider or supplier type and the individuals to whom they provide health care services. Despite these variations, our proposed regulations would provide generally consistent emergency preparedness requirements, enhance patient safety during emergencies for persons served by Medicare- and Medicaid-participating facilities, and establish a more coordinated and defined response to natural and man- made disasters.","action":"Proposed rule.","agencies":[{"raw_name":"DEPARTMENT OF HEALTH AND HUMAN SERVICES","name":"Health and Human Services Department","id":221,"url":"https://www.federalregister.gov/agencies/health-and-human-services-department","json_url":"https://www.federalregister.gov/api/v1/agencies/221","parent_id":null,"slug":"health-and-human-services-department"},{"raw_name":"Centers for Medicare & Medicaid Services","name":"Centers for Medicare & Medicaid Services","id":45,"url":"https://www.federalregister.gov/agencies/centers-for-medicare-medicaid-services","json_url":"https://www.federalregister.gov/api/v1/agencies/45","parent_id":221,"slug":"centers-for-medicare-medicaid-services"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2013/12/27/2013-30724.html","cfr_references":[{"chapter":null,"citation_url":null,"part":403,"title":42},{"chapter":null,"citation_url":null,"part":416,"title":42},{"chapter":null,"citation_url":null,"part":418,"title":42},{"chapter":null,"citation_url":null,"part":441,"title":42},{"chapter":null,"citation_url":null,"part":460,"title":42},{"chapter":null,"citation_url":null,"part":482,"title":42},{"chapter":null,"citation_url":null,"part":483,"title":42},{"chapter":null,"citation_url":null,"part":484,"title":42},{"chapter":null,"citation_url":null,"part":485,"title":42},{"chapter":null,"citation_url":null,"part":486,"title":42},{"chapter":null,"citation_url":null,"part":491,"title":42},{"chapter":null,"citation_url":null,"part":494,"title":42}],"citation":"78 FR 79082","comment_url":null,"comments_close_on":"2014-02-25","correction_of":null,"corrections":[],"dates":"To be assured consideration, comments must be received at one of the addresses provided below, no later than 5 p.m. on February 25, 2014.","disposition_notes":null,"docket_ids":["CMS-3178-P"],"dockets":[],"document_number":"2013-30724","effective_on":null,"end_page":79200,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2013/12/27/2013-30724.xml","html_url":"https://www.federalregister.gov/documents/2013/12/27/2013-30724/medicare-and-medicaid-programs-emergency-preparedness-requirements-for-medicare-and-medicaid","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2013-30724?publication_date=2013-12-27","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2013-12-27/2013-30724/mods.xml","not_received_for_publication":null,"page_length":119,"page_views":{"count":50013,"last_updated":"2026-06-25 08:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2013-12-27/pdf/2013-30724.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2013-30724.pdf?1387574230","publication_date":"2013-12-27","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2013/12/27/2013-30724.txt","regulation_id_number_info":{"0938-AO91":{"issue":"201604","html_url":"https://www.federalregister.gov/regulations/0938-AO91/emergency-preparedness-requirements-for-medicare-and-medicaid-participating-providers-and-suppliers-","title":"Emergency Preparedness Requirements for Medicare and Medicaid Participating Providers and Suppliers (CMS-3178-F)","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201604&RIN=0938-AO91&operation=OPERATION_EXPORT_XML","priority_category":"Economically Significant"}},"regulation_id_numbers":["0938-AO91"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2014-02-19T05:09:13Z"},"regulations_dot_gov_url":null,"significant":true,"signing_date":null,"start_page":79082,"subtype":null,"title":"Medicare and Medicaid Programs; Emergency Preparedness Requirements for Medicare and Medicaid Participating Providers and Suppliers","toc_doc":"Emergency Preparedness Requirements for Participating Providers and Suppliers","toc_subject":null,"topics":["Aged","Family planning","Grant programs-health","Health care","Health facilities","Health insurance","Health professions","Health records","Hospice care","Hospitals","Incorporation by reference","Infants and children","Intergovernmental relations","Kidney diseases","Medicaid","Medicare","Nursing homes","Nutrition","Penalties","Reporting and recordkeeping requirements","Rural areas","Safety","X-rays"],"type":"Proposed Rule","volume":78}
