{"abstract":"The Department of Justice (Department) is issuing this Notice of Proposed Rulemaking (NPRM) to amend its Americans with Disabilities Act (ADA) regulations in order to incorporate the statutory changes to the ADA set forth in the ADA Amendments Act of 2008 (ADA Amendments Act or the Act), which took effect on January 1, 2009. Congress enacted the ADA Amendments Act in order to revise the ADA definition of \"disability\" and to ensure that the definition is broadly construed and applied without extensive analysis. In this NPRM, the Department is proposing to add new sections to its title II and title III ADA regulations at 28 CFR parts 35 and 36, respectively, to provide detailed definitions of \"disability\" and to make consistent changes in other sections of the regulations. The ADA Amendments Act authorizes the Attorney General to issue regulations consistent with the Act that implement the definitions of \"disability\" in sections 3 and 4 of the Act, including the rules of construction set forth in section 3. The Department invites written comments from members of the public on this proposed rule.","action":"Notice of proposed rulemaking.","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2014/01/30/2014-01668.html","cfr_references":[{"chapter":null,"citation_url":null,"part":35,"title":28},{"chapter":null,"citation_url":null,"part":36,"title":28}],"citation":"79 FR 4839","comment_url":null,"comments_close_on":"2014-03-31","correction_of":null,"corrections":[],"dates":"All comments must be submitted on or before March 31, 2014.","disposition_notes":null,"docket_ids":["CRT Docket No. 124","AG Order No. 3410-2014"],"dockets":[],"document_number":"2014-01668","effective_on":null,"end_page":4862,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2014/01/30/2014-01668.xml","html_url":"https://www.federalregister.gov/documents/2014/01/30/2014-01668/office-of-the-attorney-general-amendment-of-americans-with-disabilities-act-title-ii-and-title-iii","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2014-01668?publication_date=2014-01-30","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2014-01-30/2014-01668/mods.xml","not_received_for_publication":null,"page_length":24,"page_views":{"count":4454,"last_updated":"2026-10-22 20:15:04 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2014-01-30/pdf/2014-01668.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2014-01668.pdf?1391003451","publication_date":"2014-01-30","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2014/01/30/2014-01668.txt","regulation_id_number_info":{"1190-AA59":{"issue":"201604","html_url":"https://www.federalregister.gov/regulations/1190-AA59/implementation-of-the-ada-amendments-act-of-2008-title-ii-and-title-iii-of-the-ada-","title":"Implementation of the ADA Amendments Act of 2008 (Title II and Title III of the ADA)","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201604&RIN=1190-AA59&operation=OPERATION_EXPORT_XML","priority_category":"Other Significant"}},"regulation_id_numbers":["1190-AA59"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2014-02-19T08:09:10Z"},"regulations_dot_gov_url":null,"significant":true,"signing_date":null,"start_page":4839,"subtype":null,"title":"Office of the Attorney General; Amendment of Americans with Disabilities Act Title II and Title III Regulations to Implement ADA Amendments Act of 2008","toc_doc":"Americans with Disabilities Act Title II and Title III Regulations to Implement ADA Amendments Act of 2008","toc_subject":null,"topics":["Administrative practice and procedure","Buildings and facilities","Business and industry","Civil rights","Communications","Individuals with disabilities","Reporting and recordkeeping requirements","State and local governments"],"type":"Proposed Rule","volume":79}
