{"abstract":"The Department of Justice is amending the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) regarding the making or transferring of a firearm under the National Firearms Act (NFA). This final rule defines the term \"responsible person,\" as used in reference to a trust, partnership, association, company, or corporation; requires responsible persons of such trusts or legal entities to complete a specified form and to submit photographs and fingerprints when the trust or legal entity files an application to make an NFA firearm or is listed as the transferee on an application to transfer an NFA firearm; requires that a copy of all applications to make or transfer a firearm, and the specified form for responsible persons, as applicable, be forwarded to the chief law enforcement officer (CLEO) of the locality in which the applicant/transferee or responsible person is located; and eliminates the requirement for a certification signed by the CLEO. These provisions provide a public safety benefit as they ensure that responsible persons undergo background checks. In addition, this final rule adds a new section to ATF's regulations to address the possession and transfer of firearms registered to a decedent. The new section clarifies that the executor, administrator, personal representative, or other person authorized under State law to dispose of property in an estate may possess a firearm registered to a decedent during the term of probate without such possession being treated as a \"transfer\" under the NFA. It also specifies that the transfer of the firearm to any beneficiary of the estate may be made on a tax-exempt basis.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"},{"raw_name":"Bureau of Alcohol, Tobacco, Firearms, and Explosives","name":"Alcohol, Tobacco, Firearms, and Explosives Bureau","id":19,"url":"https://www.federalregister.gov/agencies/alcohol-tobacco-firearms-and-explosives-bureau","json_url":"https://www.federalregister.gov/api/v1/agencies/19","parent_id":268,"slug":"alcohol-tobacco-firearms-and-explosives-bureau"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2016/01/15/2016-00192.html","cfr_references":[{"chapter":null,"citation_url":null,"part":479,"title":27}],"citation":"81 FR 2658","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"This rule is effective July 13, 2016.","disposition_notes":null,"docket_ids":["Docket No. ATF 41F","AG Order No. 3608-2016"],"dockets":[],"document_number":"2016-00192","effective_on":"2016-07-13","end_page":2723,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2016/01/15/2016-00192.xml","html_url":"https://www.federalregister.gov/documents/2016/01/15/2016-00192/machineguns-destructive-devices-and-certain-other-firearms-background-checks-for-responsible-persons","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2016-00192?publication_date=2016-01-15","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2016-01-15/2016-00192/mods.xml","not_received_for_publication":null,"page_length":66,"page_views":{"count":14216,"last_updated":"2026-04-22 20:15:03 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2016-01-15/pdf/2016-00192.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2016-00192.pdf?1452779134","publication_date":"2016-01-15","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2016/01/15/2016-00192.txt","regulation_id_number_info":{"1140-AA43":{"issue":"201510","html_url":"https://www.federalregister.gov/regulations/1140-AA43/machine-guns-destructive-devices-and-certain-other-firearms-background-checks-for-responsible-person","title":"Machine Guns, Destructive Devices and Certain Other Firearms; Background Checks for Responsible Persons of a Corporation, Trust, or Other Legal Entity With Respect to Making or Transferring a Firearm","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201510&RIN=1140-AA43&operation=OPERATION_EXPORT_XML","priority_category":"Other Significant"}},"regulation_id_numbers":["1140-AA43"],"regulations_dot_gov_info":{"supporting_documents":[],"comments_url":"https://www.regulations.gov/docketBrowser?rpp=50&so=DESC&sb=postedDate&po=0&dct=PS&D=ATF_FRDOC_0001","supporting_documents_count":0,"docket_id":"ATF_FRDOC_0001","regulation_id_number":null,"title":"Recently Posted ATF Rules and Notices.","checked_regulationsdotgov_at":"2016-02-04T06:00:12Z"},"regulations_dot_gov_url":null,"significant":true,"signing_date":null,"start_page":2658,"subtype":null,"title":"Machineguns, Destructive Devices and Certain Other Firearms; Background Checks for Responsible Persons of a Trust or Legal Entity With Respect To Making or Transferring a Firearm","toc_doc":"Machineguns, Destructive Devices and Certain Other Firearms; Background Checks for Responsible Persons of a Trust or Legal Entity with Respect to Making or Transferring a Firearm","toc_subject":null,"topics":["Administrative practice and procedure","Arms and munitions","Excise taxes","Exports","Imports","Military personnel","Penalties","Reporting and recordkeeping requirements","Seizures and forfeitures","Transportation"],"type":"Rule","volume":81}
