{"abstract":"In this proposed rule, the Federal Energy Regulatory Commission (Commission) amends its regulations to clarify that for all proceedings before the Commission that require a water quality certification pursuant to section 401(a)(1) of the Federal Water Pollution Control Act (Clean Water Act), the reasonable period of time during which the certifying authority may act on the water quality certification request is one year from the certifying authority's receipt of the request. The proposed rule also clarifies that all Commission authorizations that have the potential to discharge into waters of the United States require a section 401 water quality certification or waiver, including hydropower exemptions, amendments, and surrenders. Finally, the proposed rule provides updated terminology in the Commission's hydropower regulations and updates the timing of the filing requirements for the Commission's expedited hydropower licensing process.","action":"Notice of proposed rulemaking.","agencies":[{"raw_name":"DEPARTMENT OF ENERGY","name":"Energy Department","id":136,"url":"https://www.federalregister.gov/agencies/energy-department","json_url":"https://www.federalregister.gov/api/v1/agencies/136","parent_id":null,"slug":"energy-department"},{"raw_name":"Federal Energy Regulatory Commission","name":"Federal Energy Regulatory Commission","id":167,"url":"https://www.federalregister.gov/agencies/federal-energy-regulatory-commission","json_url":"https://www.federalregister.gov/api/v1/agencies/167","parent_id":136,"slug":"federal-energy-regulatory-commission"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2024/06/06/2024-11896.html","cfr_references":[{"chapter":null,"citation_url":null,"part":"4","title":18},{"chapter":null,"citation_url":null,"part":"5","title":18},{"chapter":null,"citation_url":null,"part":"6","title":18},{"chapter":null,"citation_url":null,"part":"7","title":18}],"citation":"89 FR 48351","comment_url":null,"comments_close_on":"2024-07-08","correction_of":null,"corrections":[],"dates":"Comments are due July 8, 2024.","disposition_notes":null,"docket_ids":["Docket No. RM24-5-000"],"dockets":[],"document_number":"2024-11896","effective_on":null,"end_page":48356,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2024/06/06/2024-11896.xml","html_url":"https://www.federalregister.gov/documents/2024/06/06/2024-11896/establishment-of-categorical-reasonable-period-of-time-for-action-on-requests-for-water-quality","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2024-11896?publication_date=2024-06-06","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2024-06-06/2024-11896/mods.xml","not_received_for_publication":null,"page_length":6,"page_views":{"count":407,"last_updated":"2026-10-23 22:15:05 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2024-06-06/pdf/2024-11896.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2024-11896.pdf?1717609271","publication_date":"2024-06-06","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2024/06/06/2024-11896.txt","regulation_id_number_info":{},"regulation_id_numbers":[],"regulations_dot_gov_info":{"comments_count":0,"agency_id":"FERC","document_id":"FERC-2024-0770-0001","checked_regulationsdotgov_at":"2024-06-07T12:00:17Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":48351,"subtype":null,"title":"Establishment of Categorical Reasonable Period of Time for Action on Requests for Water Quality Certification Under Section 401(a)(1) of the Clean Water Act and Clarifying Types of Hydroelectric Project Proceedings That May Require Water Quality Certification","toc_doc":"Establishment of Categorical Reasonable Period of Time for Action on Requests for Water Quality Certification","toc_subject":null,"topics":["Administrative practice and procedure","Electric power","Reporting and recordkeeping requirements"],"type":"Proposed Rule","volume":89}
