{"abstract":"With the issuance of this final rule, which constitutes a final order, the Acting Attorney General of the U.S. Department of Justice places drug products containing marijuana that have been approved by the Food and Drug Administration (FDA) in schedule III of the Controlled Substances Act (\"CSA\"). This action is required to satisfy the responsibility of the Administrator under the CSA to place a drug in the schedule he deems most appropriate to carry out United States obligations under the Single Convention on Narcotic Drugs, 1961. In general, this final rule applies to marijuana as defined in the CSA, marijuana extracts, and delta-9-tetrahydrocannabinol and other compounds derived from the marijuana plant (other than the mature stalks and seeds) that falls outside the definition of hemp, to the extent that any of these are included in an FDA-approved drug product or are subject to a state-issued license to manufacture, distribute, and/or dispense marijuana or products containing marijuana for medical purposes (\"state medical marijuana license\"). Also consistent therewith, this final rule adds such drugs to the list of substances that may only be imported or exported pursuant to a permit. This final rule also establishes an expedited registration process under 21 CFR part 1301 for entities holding state medical marijuana licenses, enabling such entities to engage in the manufacture, distribution, and/or dispensing of marijuana for medical purposes under federal law consistent with the requirements of the Single Convention.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"},{"raw_name":"Drug Enforcement Administration","name":"Drug Enforcement Administration","id":116,"url":"https://www.federalregister.gov/agencies/drug-enforcement-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/116","parent_id":268,"slug":"drug-enforcement-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2026/04/28/2026-08176.html","cfr_references":[{"chapter":null,"citation_url":null,"part":"1300","title":21},{"chapter":null,"citation_url":null,"part":"1301","title":21},{"chapter":null,"citation_url":null,"part":"1308","title":21},{"chapter":null,"citation_url":null,"part":"1312","title":21}],"citation":"91 FR 22714","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"Effective April 28, 2026.","disposition_notes":null,"docket_ids":["AG Order No. 6754-2026"],"dockets":[],"document_number":"2026-08176","effective_on":"2026-04-28","end_page":22723,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2026/04/28/2026-08176.xml","html_url":"https://www.federalregister.gov/documents/2026/04/28/2026-08176/schedules-of-controlled-substances-rescheduling-of-food-and-drug-administration-approved-products","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2026-08176?publication_date=2026-04-28","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2026-04-28/2026-08176/mods.xml","not_received_for_publication":null,"page_length":10,"page_views":{"count":7,"last_updated":"2026-04-28 08:15:06 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2026-04-28/pdf/2026-08176.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2026-08176.pdf?1777293907","publication_date":"2026-04-28","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2026/04/28/2026-08176.txt","regulation_id_number_info":{},"regulation_id_numbers":[],"regulations_dot_gov_info":{},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":22714,"subtype":null,"title":"Schedules of Controlled Substances: Rescheduling of Food and Drug Administration Approved Products Containing Marijuana From Schedule I to Schedule III; Corresponding Change to Permit Requirements","toc_doc":"Rescheduling of Food and Drug Administration Approved Products Containing Marijuana from Schedule I to Schedule III; Corresponding Change to Permit Requirements","toc_subject":"Schedules of Controlled Substances","topics":["Administrative practice and procedure","Drug traffic control","Exports","Imports","Reporting and recordkeeping requirements"],"type":"Rule","volume":91}
