{"abstract":"The Merit Systems Protection Board (MSPB or Board) is issuing a final rule amending its regulations governing the Board's review of the reasonableness of an agency's chosen penalty in misconduct-based adverse actions appealed to the Board. Under the final rule, the Board will no longer require consideration of the 12 factors set forth in Douglas v. Veterans Administration, 5 M.S.P.R. 280 (1981), in every case. Instead, the Board will evaluate whether the agency's penalty is within the tolerable limits of reasonableness in light of the totality of the circumstances, determined on a case-by-case basis.","action":"Final rule.","agencies":[{"raw_name":"MERIT SYSTEMS PROTECTION BOARD","name":"Merit Systems Protection Board","id":285,"url":"https://www.federalregister.gov/agencies/merit-systems-protection-board","json_url":"https://www.federalregister.gov/api/v1/agencies/285","parent_id":null,"slug":"merit-systems-protection-board"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2026/09/03/2026-18061.html","cfr_references":[{"chapter":null,"citation_url":null,"part":"1201","title":5}],"citation":"91 FR 56549","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"Effective date: This rule is effective October 5, 2026.","disposition_notes":null,"docket_ids":["Docket ID: OPM-2025-0012"],"dockets":[],"document_number":"2026-18061","effective_on":"2026-10-05","end_page":56574,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2026/09/03/2026-18061.xml","html_url":"https://www.federalregister.gov/documents/2026/09/03/2026-18061/determining-the-appropriate-penalty-for-federal-employees-charged-with-misconduct","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/2026-18061?publication_date=2026-09-03","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2026-09-03/2026-18061/mods.xml","not_received_for_publication":null,"page_length":26,"page_views":{"count":4818,"last_updated":"2026-10-24 02:15:05 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2026-09-03/pdf/2026-18061.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2026-18061.pdf?1788353117","publication_date":"2026-09-03","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2026/09/03/2026-18061.txt","regulation_id_number_info":{"3124-AA35":null},"regulation_id_numbers":["3124-AA35"],"regulations_dot_gov_info":{"comments_count":0,"agency_id":"MSPB","document_id":"MSPB-2026-0166-0001","checked_regulationsdotgov_at":"2026-09-04T15:55:04Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":56549,"subtype":null,"title":"Determining the Appropriate Penalty for Federal Employees Charged With Misconduct","toc_doc":"Determining the Appropriate Penalty for Federal Employees Charged with Misconduct","toc_subject":null,"topics":["Administrative practice and procedure","Government employees"],"type":"Rule","volume":91}
