{"abstract":"The Nuclear Regulatory Commission (``NRC'' or ``Commission'') received a petition for rulemaking submitted by the American Mining Congress (``petitioner'') concerning the licensing, inspection and annual fees assessed by the NRC. The petitioner requested that the NRC amend its regulations to alleviate what the petitioner claimed are inequitable impacts of NRC user and annual fees on its members, specifically for uranium recovery sites with conventional mills that have ceased operations and are awaiting NRC approval of their reclamation plans. The petitioner claimed that there is a lack of a rational relationship between fees and regulatory services. The petitioner requested that the fee be waived for any licensed facility serving solely as a cost center and not generating revenues; that licensees be given the ability to review and have input into the NRC's budget and fee development and that annual fees only be increased in proportion to normal inflation rates; that time limits be established for NRC's processing of amendment requests and cost sheets showing sample charges be provided to licensees; that more detailed information be provided to support the bills for licensing and inspection services; and that the Department of Energy (DOE) be assessed costs for NRC review of DOE sites under the Uranium Mill Tailings Radiation Control Act (UMTRCA). After careful consideration, the Commission has decided to deny the petition for rulemaking but notes that (1) the NRC will continue its current practice of providing available backup data to support Part 170 licensing and inspection billings upon request by the licensee or applicant and (2) petitioner's request that DOE be assessed fees for its UMTRCA actions was implemented in the final fee rule for FY 1994.","action":"Denial of petition for rulemaking.","agencies":[{"raw_name":"NUCLEAR REGULATORY COMMISSION","name":"Nuclear Regulatory Commission","id":383,"url":"https://www.federalregister.gov/agencies/nuclear-regulatory-commission","json_url":"https://www.federalregister.gov/api/v1/agencies/383","parent_id":null,"slug":"nuclear-regulatory-commission"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/1995/04/28/95-10477.html","cfr_references":[{"chapter":null,"citation_url":null,"part":170,"title":10},{"chapter":null,"citation_url":null,"part":171,"title":10}],"citation":"60 FR 20918","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":null,"disposition_notes":null,"docket_ids":["Docket No. PRM-170-4"],"dockets":[],"document_number":"95-10477","effective_on":null,"end_page":20922,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":null,"html_url":"https://www.federalregister.gov/documents/1995/04/28/95-10477/american-mining-congress-denial-of-petition-for-rulemaking","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/95-10477?publication_date=1995-04-28","mods_url":"https://www.govinfo.gov/metadata/granule/FR-1995-04-28/95-10477/mods.xml","not_received_for_publication":null,"page_length":5,"page_views":{"count":18,"last_updated":"2026-08-25 12:15:05 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-1995-04-28/pdf/95-10477.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"1995-04-28","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/1995/04/28/95-10477.txt","regulation_id_number_info":{},"regulation_id_numbers":[],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-09-21T03:33:12Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":20918,"subtype":null,"title":"American Mining Congress; Denial of Petition for Rulemaking","toc_doc":null,"toc_subject":null,"topics":[],"type":"Proposed Rule","volume":60}
