{"abstract":"This final rule implements section 8010 of the Omnibus Budget Reconciliation Act of 1989 which provides that a disabled child under age 18 who lives with his or her parent(s) will not have parental income or resources deemed to him or her if the child previously received a reduced supplemental security income (SSI) benefit (personal needs allowance) while a resident of a medical facility for which Medicaid paid more than 50 percent of the cost of the individual's care; the child is eligible for medical assistance under a Medicaid State home care plan; and the child would otherwise be ineligible for a Federal SSI benefit because of the deeming of the parents' income or resources. The rule also provides that, although deeming is waived in these circumstances, the in-kind support and maintenance provided by the parents will not be counted. Lastly, when such a child would not be ineligible because of the deeming of his parents' income but would receive a benefit of less than the amount payable under section 8010, the child's benefit will be $30 a month plus any optional State supplementation. Any of the child's own countable income will then be deducted from that amount.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF HEALTH AND HUMAN SERVICES","name":"Health and Human Services Department","id":221,"url":"https://www.federalregister.gov/agencies/health-and-human-services-department","json_url":"https://www.federalregister.gov/api/v1/agencies/221","parent_id":null,"slug":"health-and-human-services-department"},{"raw_name":"Social Security Administration","name":"Social Security Administration","id":470,"url":"https://www.federalregister.gov/agencies/social-security-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/470","parent_id":null,"slug":"social-security-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/1995/01/04/95-115.html","cfr_references":[{"chapter":null,"citation_url":null,"part":"416","title":20}],"citation":"60 FR 360","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"This rule is effective January 4, 1995.","disposition_notes":null,"docket_ids":["Regulation No. 16"],"dockets":[],"document_number":"95-115","effective_on":"1995-01-04","end_page":362,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":null,"html_url":"https://www.federalregister.gov/documents/1995/01/04/95-115/supplemental-security-income-for-the-aged-blind-and-disabled-waiver-of-parent-to-child-deeming-for","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/95-115?publication_date=1995-01-04","mods_url":"https://www.govinfo.gov/metadata/granule/FR-1995-01-04/95-115/mods.xml","not_received_for_publication":null,"page_length":3,"page_views":{"count":48,"last_updated":"2026-10-25 04:15:05 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-1995-01-04/pdf/95-115.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"1995-01-04","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/1995/01/04/95-115.txt","regulation_id_number_info":{"0960-AC96":null},"regulation_id_numbers":["0960-AC96"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-09-20T22:25:08Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":360,"subtype":null,"title":"Supplemental Security Income for the Aged, Blind, and Disabled; Waiver of Parent-to-Child Deeming for Certain Disabled Children","toc_doc":null,"toc_subject":null,"topics":[],"type":"Rule","volume":60}
