{"abstract":"The FHWA is amending its regulations on utilities. These amendments eliminate the requirement for FHWA preaward review and/or approval of consultant contracts for preliminary engineering and increase the ceiling for lump sum agreements from $25,000 to $100,000. They clarify the meaning of the term ``approved program'' and the methodology to be used to compute indirect or overhead rates. They require utilities to submit final billings within one year following completion of the utility relocation work. They eliminate the requirements for State highway agencies (SHAs) to certify the completion of utility work and to provide evidence of payment prior to reimbursement. They bring the definition of ``clear zone'' into conformance with the American Association of State Highway and Transportation Officials (AASHTO) ``Roadside Design Guide.'' Finally, they incorporate an amendment conforming the utilities regulations to the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA), Pub. L. 102-240, 105 Stat. 1914. The FHWA is making these changes to conform the utilities regulations to more recent laws, regulations, and guidance; to clarify these regulations; and to give the SHAs more flexibility in implementing them.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF TRANSPORTATION","name":"Transportation Department","id":492,"url":"https://www.federalregister.gov/agencies/transportation-department","json_url":"https://www.federalregister.gov/api/v1/agencies/492","parent_id":null,"slug":"transportation-department"},{"raw_name":"Federal Highway Administration","name":"Federal Highway Administration","id":170,"url":"https://www.federalregister.gov/agencies/federal-highway-administration","json_url":"https://www.federalregister.gov/api/v1/agencies/170","parent_id":492,"slug":"federal-highway-administration"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/1995/07/05/95-16403.html","cfr_references":[{"chapter":null,"citation_url":null,"part":645,"title":23}],"citation":"60 FR 34846","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"This final rule is effective August 4, 1995.","disposition_notes":null,"docket_ids":["FHWA Docket No. 94-8"],"dockets":[],"document_number":"95-16403","effective_on":"1995-08-04","end_page":34851,"executive_order_notes":null,"executive_order_number":null,"full_text_xml_url":null,"html_url":"https://www.federalregister.gov/documents/1995/07/05/95-16403/utilities","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/95-16403?publication_date=1995-07-05","mods_url":"https://www.govinfo.gov/metadata/granule/FR-1995-07-05/95-16403/mods.xml","not_received_for_publication":null,"page_length":6,"page_views":{"count":57,"last_updated":"2026-10-24 16:15:04 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-1995-07-05/pdf/95-16403.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"1995-07-05","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/1995/07/05/95-16403.txt","regulation_id_number_info":{"2125-AD31":null},"regulation_id_numbers":["2125-AD31"],"regulations_dot_gov_info":{"checked_regulationsdotgov_at":"2011-09-21T05:54:21Z"},"regulations_dot_gov_url":null,"significant":null,"signing_date":null,"start_page":34846,"subtype":null,"title":"Utilities","toc_doc":null,"toc_subject":null,"topics":[],"type":"Rule","volume":60}
