{"abstract":"Through this final rule, the Centers for Disease Control and Prevention (CDC), within the U.S. Department of Health and Human Services (HHS), is amending its regulations to remove \"Human Immunodeficiency Virus (HIV) infection\" from the definition of communicable disease of public health significance and remove references to \"HIV\" from the scope of examinations for aliens. Prior to this final rule, aliens with HIV infection were considered to have a communicable disease of public health significance and were thus inadmissible to the United States per the Immigration and Nationality Act (INA). While HIV infection is a serious health condition, it is not a communicable disease that is a significant public health risk for introduction, transmission, and spread to the U.S. population through casual contact. As a result of this final rule, aliens will no longer be inadmissible into the United States based solely on the ground they are infected with HIV, and they will not be required to undergo HIV testing as part of the required medical examination for U.S. immigration.","action":"Final rule.","agencies":[{"raw_name":"DEPARTMENT OF HEALTH AND HUMAN SERVICES","name":"Health and Human Services Department","id":221,"url":"https://www.federalregister.gov/agencies/health-and-human-services-department","json_url":"https://www.federalregister.gov/api/v1/agencies/221","parent_id":null,"slug":"health-and-human-services-department"},{"raw_name":"Centers for Disease Control and Prevention","name":"Centers for Disease Control and Prevention","id":44,"url":"https://www.federalregister.gov/agencies/centers-for-disease-control-and-prevention","json_url":"https://www.federalregister.gov/api/v1/agencies/44","parent_id":221,"slug":"centers-for-disease-control-and-prevention"}],"body_html_url":"https://www.federalregister.gov/documents/full_text/html/2009/11/02/E9-26337.html","cfr_references":[{"chapter":null,"citation_url":null,"part":34,"title":42}],"citation":"74 FR 56547","comment_url":null,"comments_close_on":null,"correction_of":null,"corrections":[],"dates":"This final rule is effective January 4, 2010.","disposition_notes":null,"docket_ids":["Docket No. CDC-2009-0003"],"dockets":[],"document_number":"E9-26337","effective_on":"2010-01-04","end_page":56562,"executive_order_notes":null,"executive_order_number":null,"explanation":null,"full_text_xml_url":"https://www.federalregister.gov/documents/full_text/xml/2009/11/02/E9-26337.xml","html_url":"https://www.federalregister.gov/documents/2009/11/02/E9-26337/medical-examination-of-aliens-removal-of-human-immunodeficiency-virus-hiv-infection-from-definition","images":{},"images_metadata":{},"json_url":"https://www.federalregister.gov/api/v1/documents/E9-26337?publication_date=2009-11-02","mods_url":"https://www.govinfo.gov/metadata/granule/FR-2009-11-02/E9-26337/mods.xml","not_received_for_publication":null,"page_length":16,"page_views":{"count":4487,"last_updated":"2026-04-17 22:15:06 -0400"},"pdf_url":"https://www.govinfo.gov/content/pkg/FR-2009-11-02/pdf/E9-26337.pdf","presidential_document_number":null,"proclamation_number":null,"public_inspection_pdf_url":null,"publication_date":"2009-11-02","raw_text_url":"https://www.federalregister.gov/documents/full_text/text/2009/11/02/E9-26337.txt","regulation_id_number_info":{"0920-AA26":{"issue":"200904","html_url":"https://www.federalregister.gov/regulations/0920-AA26/medical-examination-of-aliens-removal-of-hiv-infection-as-a-communicable-disease-of-public-health-si","title":"Medical Examination of Aliens: Removal of HIV Infection as a Communicable Disease of Public Health Significance","xml_url":"http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=200904&RIN=0920-AA26&operation=OPERATION_EXPORT_XML","priority_category":"Economically Significant"}},"regulation_id_numbers":["0920-AA26"],"regulations_dot_gov_info":{"supporting_documents":[{"title":"Select Agent: Determination that Vaccine Strain, TC-83(A3G) of Venezuelan Equine Encephalitis Virus is a Regulated Strain of VEEV","document_id":"CDC_FRDOC_0001-0125"},{"title":"Order Suspending Introduction of Persons from a Country Where a Communicable Disease Exists","document_id":"CDC_FRDOC_0001-0118"},{"title":"World Trade Center Health Program: Petition 025-Parkinson's Disease and Parkinsonism, Including Heavy Metal-Induced Parkinsonism;
