The Secretary announces the guidance documents the Department of Education (Department) is rescinding because they are outdated, after conducting a review of its guidance under Executive Order (E.O.) 13891.

SUPPLEMENTARY INFORMATION:

On October 9, 2019, the President issued E.O. 13891 titled “Promoting the Rule of Law Through Improved Agency Guidance Documents.” 84 FR 55235. Section 3(b) of the E.O. requires the Department to “review its guidance documents and, consistent with applicable law, rescind those guidance documents that it determines should no longer be in effect.” This notice notifies the public, including the Department's stakeholders, of the guidance documents the Department rescinds as outdated (e.g., superseded by subsequent statutory amendments or enactments), in accordance with section 3(b) of E.O. 13891. The guidance documents identified as being rescinded in this notice do not include any guidance documents the Department has, is considering, or is planning to rescind through exercising the Department's policy-making discretion (i.e., rescissions based on a change in Department policy or statutory interpretation).

Additionally, section 3(a) of E.O. 13891 requires the Department to develop a guidance portal that contains or links to all of its guidance documents in effect. On February 26, 2020, the Department published a notice in the Federal Register announcing that its guidance portal was operational, in compliance with section 3(a) of the E.O. 85 FR 11056.

Section 4 of E.O. 13891 requires the Department to finalize regulations to set forth processes and procedures for issuing guidance documents. The Department's Spring 2020 Unified Agenda provides that the timetable for these interim final regulations is August 2020.
