The OFR/GPO partnership is committed to presenting accurate and reliable regulatory information on FederalRegister.gov with the objective of establishing the XML-based Federal Register as an ACFR-sanctioned publication in the future. While every effort has been made to ensure that the material on FederalRegister.gov is accurately displayed, consistent with the official SGML-based PDF version on govinfo.gov, those relying on it for legal research should verify their results against an official edition of the Federal Register. Until the ACFR grants it official status, the XML rendition of the daily Federal Register on FederalRegister.gov does not provide legal notice to the public or judicial notice to the courts.
Take notice that on February 18, 2025, Southern Star Central Gas Pipeline, Inc. (Southern Star) requested that the Commission grant an extension of time, until August 29, 2025, to construct and place into service its Abandonment by Sale (Project) located in the State of Kansas as authorized in the Order Approving Abandonment (Order).[1] The Order required Southern Star to complete construction of the Project and make it available for service within one year of the date of the Order, or by February 28, 2025.
On March 29, 2024, Black Hills Energy (BHE) filed a petition with the Kansas Corporation Commission (KCC) to request approval of the sale (March 29 Petition) in Docket No. 24-BHCG-652-ACQ. On January 23, 2025, the KCC issued an Order Acknowledging Extension of Time, extending the deadline to issue a final order to March 24, 2025. The KCC has yet to issue a final order either approving or denying BHE's petition. Due to the absence of approval from the KCC that either accepts or denies BHE's March 29 Petition, Southern Star requests an extension until August 29, 2025.
This notice establishes a 15-calendar day intervention and comment period deadline. Any person wishing to comment on Southern Star's request for an extension of time may do so. No reply comments or answers will be considered. If you wish to obtain legal status by becoming a party to the proceedings for this request, you should, on or before the comment date stated below, file a motion to intervene in accordance with the requirements of the Commission's Rules of Practice and Procedure (18 CFR 385.214 or 385.211) and the Regulations under the Natural Gas Act (NGA) (18 CFR 157.10).
As a matter of practice, the Commission itself generally acts on requests for extensions of time to complete construction for NGA facilities when such requests are contested before order issuance. For those extension requests that are contested,[2] the Commission will aim to issue an order acting on the request within 45 days.[3] The Commission will address all arguments relating to whether the applicant has demonstrated there is good cause to grant the extension.[4] The Commission will not consider arguments that re-litigate the issuance of the certificate order, including whether the Commission properly found the project to be in the public convenience and necessity and whether the Commission's environmental analysis for the certificate complied with the National Environmental Policy Act (NEPA).[5] At the time a pipeline requests an extension of time, orders on certificates of public convenience and necessity are final and the Commission will not re-litigate their issuance.[6] The Director of the Office of Energy Projects, or his or her designee, will act on all of those extension requests that are uncontested.
