Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on April 8, 2002, under section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. 1337, on behalf of Mosel Vitelic Inc. of Hsinchu, Taiwan and Mosel Vitelic Corp. of San Jose, California. A supplement to the complaint was filed on April 25, 2002. The complaint, as supplemented, alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain semiconductor memory devices and products containing same by reason of infringement of claims 1, 2, 4, 5, 7-10, 12, and 14 of U.S. Letters Patent 5,452,261, claims 12-14, 20, 21, 23, 28, and 29 of U.S. Letters Patent 5,412,257, and claims 1, 2, and 4-8 of U.S. Letters Patent 5,917,214. The complaint further alleges that an industry in the United States exists or is in the process of being established as required by subsection (a)(2) of section 337.
The complainant requests that the Commission institute an investigation and, after the investigation, issue a permanent exclusion order and permanent cease and desist orders.
