This is a request to renew an existing approved collection. This ICR is scheduled to expire on November 30, 2005. EPA has submitted the following ICR to OMB for review and approval according to the procedures prescribed in 5 CFR 1320.12. On May 6, 2005 (70 FR 24020), EPA sought comments on this ICR pursuant to 5 CFR 1320.8(d). EPA received no comments.

Title: NSPS for Petroleum Refineries (Renewal).
Abstract: This information collection request addresses Clean Air Act information collection requirements in standards published at 40 CFR part 60, subpart J, which have mandatory recordkeeping and reporting requirements. These regulations were proposed on June 11, 1973, promulgated on March 8, 1974, and they apply to the following affected facilities in petroleum refineries: Fluid catalytic cracking unit catalyst regenerators, fuel gas combustion devices, and Claus sulfur recovery plants of more than 20 long tons per day commencing construction, modification or reconstruction after the date of proposal. In general, all NSPS standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. The frequency of the excess emissions report was changed from quarterly to semiannually on February 12, 1999 (64 FR 7465) They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NSPS.
Any owner/operator subject to the provisions of this part shall maintain a file of these measurements, and retain the file for at least two years following the date of such measurements, maintenance reports, and records. All reports are sent to the delegated state or local authority. In the event that there is no such delegated authority, the reports are sent directly to the United States Environmental Protection Agency (EPA) regional office.
An agency may not conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB Control Number. The OMB Control Numbers for EPA's regulations are listed in 40 CFR part 9 and 48 CFR chapter 15, and are identified on the form and/or instrument, if applicable.
Burden Statement: The annual public reporting and recordkeeping burden for this collection of information is estimated to average 50 hours per response. Burden means the total time, effort, or financial resources expended by persons to generate, maintain, retain, or disclose or provide information to or for a federal agency. This includes the time needed to review instructions; develop, acquire, install, and utilize technology and systems for the purposes of collecting, validating, and verifying information, processing and maintaining information, and disclosing and providing information; adjust the existing ways to comply with any previously applicable instructions and requirements; train personnel to be able to respond to a collection of information; search data sources; complete and review the collection of information; and transmit or otherwise disclose the information.
Respondents/Affected Entities: Owners and operators of petroleum refineries.
Estimated Number of Respondents: 132.
Frequency of Response: Semiannually, on occasion.
Estimated Total Annual Hour Burden: 14,134 hours.
Estimated Total Annual Costs: $1,682,453, which includes $0 annualized capital/startup costs, $541,464 annual O&M costs, and $1,140,989 in Respondent Labor costs. Start Printed Page 55130
Changes in the Estimates: Adjustment of burden hours added 2,183 hours, but was more than offset by Program Change decrease of 5,408 hours, so that the overall decrease in burden was 3,225 hours per year. This decrease is due to the removal of quarterly emission reporting requirements. Only semiannual emission reporting is required by the standards. The increase in O&M cost is due to use of a more accurate source for this information.Start Signature
