Nature and Extent of Confidentiality: The Commission is not requesting that the respondents submit confidential information to the FCC. Respondents may, however, request confidential treatment for information they believe to be confidential under 47 CFR 0.459 of the Commission's rules.
Needs and Uses: Section 222 of the Communications Act of 1934, as amended, 47 U.S.C. 222, establishes a duty of every telecommunications carrier to protect the confidentiality of its customers' CPNI, which includes personally identifiable information derived from a customer's relationship with a provider of communications services. This information collection implements the statutory obligations of section 222. These regulations impose safeguards to protect customers' CPNI against unauthorized access and disclosure. In March 2007, the Commission adopted new rules in the CPNI Order, CC Docket No. 96-115 et al., FCC 07-22, which focused on the efforts of providers of communications services to prevent pretexting. These rules required providers of communications services to adopt additional privacy safeguards that, the Commission believes, will sharply limit pretexters' ability to obtain unauthorized access to the type of personal customer information from carriers that the Commission regulates. In addition, in furtherance of the Telephone Records and Privacy Protection Act of 2006, the Commission's rules help ensure that law enforcement will have necessary tools to investigate and enforce prohibitions on illegal access to customer records.Start Signature
