This prototype edition of the daily Federal Register on FederalRegister.gov will remain an unofficial informational resource until the Administrative Committee of the Federal Register (ACFR) issues a regulation granting it official legal status. The OFR/GPO partnership is committed to presenting accurate and reliable regulatory information on FederalRegister.gov with the objective of establishing the XML-based Federal Register as an ACFR-sanctioned publication in the future. While every effort has been made to ensure that the material on FederalRegister.gov is accurately displayed, consistent with the official SGML-based PDF version on govinfo.gov, those relying on it for legal research should verify their results against an official edition of the Federal Register. Until the ACFR grants it official status, the XML rendition of the daily Federal Register on FederalRegister.gov does not provide legal notice to the public or judicial notice to the courts.
On September 4, 2009, FFP Qualified Hydro 20 LLC filed an application for a preliminary permit, pursuant to section 4(f) of the Federal Power Act, proposing to study the feasibility of the Green River Lock and Dam No. 1 Water Power Project, located on the Green River, in Henderson County, Kentucky. The sole purpose of a preliminary permit, if issued, is to grant the permit holder priority to file a license application during the permit term. A preliminary permit does not authorize the permit holder to perform any land disturbing activities or otherwise enter upon lands or waters owned by others without the owners' express permission.
The proposed project would consist of the following:
(1) A 125-ft by 250-ft long power canal; (2) a newly excavated 150-ft by 300-ft tailrace; (3) a 30-ft by 60-ft control building; (4) a new 5 MVA substation; (5) a 1,900-ft long transmission line; and (6) appurtenant facilities. The proposed Green River Lock and Dam No. 1 Hydroelectric Project would have an average annual generation of 27 gigawatt-hours.
