Weatherization Assistance For Low-Income Persons: Maintaining the Privacy of Recipients of Services

This final rule requires all States and other service providers that participate in the Weatherization Assistance Program (WAP) to treat all information obtained under the WAP, regarding applicants and recipients of WAP funds, in a manner consistant with Freedom of Information Act, 5 U.S.C. 552, including the privacy protections contained in 5 U.S.C. 552(e)(6), and must extend this protection to all WAP records in their possession, custody, or control. However, information regarding recipients in the aggregate that does not identify specific individuals, may be released. For example, a State or other service provider may disclose information on the number of WAP recipients in a county, city, or a zip code.
